Agreement to These Terms

This website is owned and operated by Still Water Therapy, LLC ("Still Water Therapy," "we," "us," or "our"), a limited liability company organized under the laws of the State of Texas, with offices at 1322 Space Park Drive, Suite C185, Houston, Texas 77058. These Terms of Use ("Terms") govern your access to and use of stillwatertherapyllc.com and any associated pages, content, and features (collectively, the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of the Site. We may update these Terms from time to time. Changes take effect when posted, and the "Last Updated" date above will reflect the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

The Site Is Informational Only

The Site exists to share general information about our practice, our clinicians, and the services we offer. Content on this Site is not mental health advice, medical advice, diagnosis, or treatment. It is general information only and is not a substitute for consultation with a qualified licensed professional who knows your individual circumstances. Using this Site does not create a therapist-client relationship. A professional relationship with Still Water Therapy is established only after you have completed our intake process, signed the required consent and practice documents, and been formally accepted as a client by one of our clinicians. Browsing the Site, reading our content, submitting a form, requesting a consultation, or sending us an email does not by itself create that relationship. Never disregard professional advice, or delay seeking it, because of something you read on this Site.

Emergencies and Crisis Situations

Still Water Therapy is not an emergency or crisis service. We do not monitor this Site, our email, or our voicemail continuously, and we cannot respond to urgent or emergency communications in real time. If you or someone you know is experiencing a mental health emergency, is in immediate danger, or is having thoughts of harming themselves or others:

  • Call or text 988 to reach the Suicide and Crisis Lifeline

  • Dial 911 or go to your nearest emergency room.

Do not use this Site, our contact form, email, or voicemail to communicate an emergency.

Scope of Practice and Licensure

Our clinicians are licensed to provide mental health services only in the states where they hold an active license. We currently provide in-person services in Texas and telehealth services in Texas, Florida, and Louisiana, subject to each clinician's individual licensure. The Site is accessible from anywhere, but the availability of information on the Site is not an offer to provide services in any jurisdiction where we are not licensed to practice. Services are available only to individuals physically located in a state where the treating clinician is licensed at the time of the session. Any information provided on this Site regarding services, availability, or fees is subject to change and does not constitute a guarantee that services will be available to you.

Scheduling, Fees, and Third-Party Platforms

Appointment requests, client intake, telehealth sessions, and client portal access are handled through SimplePractice, a third-party practice management platform. When you click a scheduling or client portal link on our Site, you leave our Site and enter a platform governed by SimplePractice's own terms and privacy policy. We encourage you to review them. Fees, session rates, and accepted insurance plans described on the Site are provided for general informational purposes and are subject to change. Published self-pay rates reflect ranges and may vary by clinician, session type, and session length. Coverage, copays, deductibles, and benefits are determined by your insurance carrier, not by us, and it is your responsibility to verify your benefits. Nothing on this Site guarantees coverage or a specific out-of-pocket cost. Clients receiving services on a self-pay basis are entitled to a Good Faith Estimate of expected charges. Permitted Use of the Site

You may use the Site for lawful, personal, non-commercial purposes only. You agree not to:

  • Use the Site in any way that violates any applicable law or regulation

  • Attempt to gain unauthorized access to the Site, our systems, or any connected network

  • Interfere with, disrupt, overload, or impair the operation or security of the Site

  • Use automated tools to access, copy, scan, or collect content from the Site without our written permission

  • Copy, reproduce, republish, distribute, or create derivative works from Site content except as permitted in Section 7

  • Impersonate any person or misrepresent your affiliation with any person or entity

  • Post, transmit, or submit any content that is unlawful, harassing, defamatory, threatening, or infringing on the rights of others

  • Use the Site or any content on it to provide services to others or for any commercial purpose.

We reserve the right to restrict or terminate access to the Site, at our discretion and without notice, for any conduct we believe violates these Terms.

Intellectual Property

All content on the Site, including text, written materials, articles, graphics, logos, images, page layouts, and the Still Water Therapy name and marks, is owned by Still Water Therapy, LLC or its licensors and is protected by United States copyright, trademark, and other intellectual property laws. You may view, download, and print Site content for your own personal, non-commercial reference. You may not otherwise reproduce, distribute, modify, publicly display, or use our content or marks without our prior written permission. Photographs appearing on this Site may be licensed stock images and do not depict actual clients of Still Water Therapy. If you believe content on this Site infringes your copyright, please contact us at info@stillwatertherapyllc.com with a description of the material and your contact information.

Communications and Information You Send Us

If you contact us through the Site, by email, or by phone, please be aware that email, web forms, and voicemail are not fully secure or confidential methods of communication. Do not send sensitive personal, clinical, or health information through these channels. Any communication you send us before establishing a formal therapeutic relationship is not protected by therapist-client privilege in the way that communications within an established treatment relationship are. Once you become a client, protected health information is handled in accordance with HIPAA and our Notice of Privacy Practices. We do not guarantee a specific response time to inquiries submitted through the Site. Any information or feedback you submit to us that is not protected health information may be used by us without restriction or obligation to you.

Third-Party Links

The Site may contain links to third-party websites, resources, or platforms that we do not own or control. These links are provided for convenience and general information only. We do not endorse, and are not responsible for, the content, accuracy, availability, privacy practices, or services of any third-party site. Accessing a third-party site is at your own risk and subject to that site's own terms and policies.

Privacy and Cookies

Our Site is hosted on the Squarespace platform, which may automatically collect limited technical and analytics information such as pages visited, browser type, device type, and general location, and may place cookies on your device to support basic site functionality and traffic measurement. We do not use this Site to collect protected health information. Information collected through the Site is separate from the clinical records we maintain for clients, which are governed by HIPAA and described in our Notice of Privacy Practices. Most browsers allow you to refuse or delete cookies through your settings. Doing so may affect how parts of the Site function.

Disclaimer of Warranties

The Site and all content on it are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We make no representation or warranty that the Site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any content on the Site is accurate, complete, current, or applicable to your situation.

Limitation of Liability

To the fullest extent permitted by law, Still Water Therapy, LLC and its owners, members, clinicians, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of data, revenue, profits, or goodwill, arising out of or related to your access to or use of, or inability to use, the Site or any content on it, whether based in contract, tort, negligence, strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability arising out of or relating to the Site shall not exceed one hundred U.S. dollars ($100.00). Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, and nothing in these Terms is intended to limit any rights you may have as a client with respect to professional services actually rendered to you.

Indemnification

You agree to indemnify, defend, and hold harmless Still Water Therapy, LLC and its owners, members, clinicians, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

Governing Law and Venue

These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Texas, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction and venue of those courts.

Age of Users

The Site is intended for use by adults 18 years of age and older. We do not knowingly collect information through the Site from children under 13. While we provide clinical services to adolescents ages 13 and older, all scheduling, intake, consent, and financial arrangements for a minor client must be completed by a parent or legal guardian with authority to consent to the minor's care.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later. These Terms, together with our Notice of Privacy Practices, Disclaimer, and Good Faith Estimate notice, constitute the entire agreement between you and Still Water Therapy, LLC regarding your use of the Site.
